WAIVER OF LIABILITY, ASSUMPTION OF RISK & INDEMNIFICATION AGREEMENT
By registering my child for Miss Grace's Sewing Class ("the Program"), I, the undersigned parent or legal guardian, acknowledge and agree to the following:
1. Assumption of Risk. I understand that participation in sewing classes involves inherent risks, including but not limited to: cuts, puncture wounds, or abrasions from scissors, needles, pins, seam rippers, and other sharp sewing tools; burns from irons or hot surfaces; eye strain or injury; pinched fingers from sewing machine mechanisms; allergic reactions to fabrics, dyes, or materials; and other injuries that may occur during instruction. I voluntarily assume all such risks on behalf of my child.
2. Release of Liability. I hereby release, waive, and discharge Grace King, Miss Grace's Sewing Class, and any of its instructors, assistants, helpers, volunteers, and representatives (collectively, "Released Parties") from any and all liability, claims, demands, or causes of action arising out of or related to any injury, illness, damage, or loss sustained by my child during or as a result of participation in the Program, whether caused by negligence or otherwise.
3. Equipment Responsibility. I understand that my child is required to bring their own sewing machine and scissors. The Released Parties are not responsible for any damage to, malfunction of, or loss of personal equipment, including but not limited to sewing machines, scissors, tools, fabrics, or other personal belongings brought to class. Any repairs or replacement costs for personal equipment are solely my responsibility.
4. No Refund Policy. I understand and agree that all registration fees are non-refundable. This includes, but is not limited to, cancellations for any reason, schedule conflicts, illness, failure to attend, dissatisfaction with the Program, or withdrawal from the Program after registration. Fabric fees, if selected, are also non-refundable.
5. Medical Authorization. In the event of an emergency, I authorize the Released Parties to seek and obtain emergency medical treatment for my child. I understand that any medical costs incurred are solely my responsibility.
6. Photo & Media Release. I grant permission for the Released Parties to photograph or video record my child during class activities. These images may be used for promotional purposes, including but not limited to social media, the Program website, and marketing materials. If I do not consent to media use, I will notify the instructor in writing prior to the first class.
7. Supervision & Conduct. I understand that the instructor is responsible for teaching sewing skills and providing general supervision during class time only. I am responsible for my child's behavior. The Released Parties reserve the right to dismiss any student whose behavior is disruptive or poses a safety risk to themselves or others, without refund.
8. Indemnification. I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, suits, procedures, costs, expenses (including attorneys' fees), damages, and liabilities arising out of or related to my child's participation in the Program, including claims brought by third parties.
9. Governing Law. This agreement shall be governed by and construed in accordance with the laws of the State of Utah. Any disputes arising under this agreement shall be resolved in the courts of Utah County, Utah.
10. Severability. If any provision of this agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
11. Entire Agreement. This waiver constitutes the entire agreement between the parties regarding the subject matter herein and supersedes all prior agreements or understandings.
